Roche Ltd., Basel, Switzerland and is provided only for the use in research. Information about
licenses for commercial use is available from Qiagen GmbH, Max-Volmer-Str. 4, D-40724
Hilden, Germany.
CMV promoter
Use of the CMV promoter is covered under U.S. Patents 5,168,062 and 5,385,839 owned
and licensed by the University of Iowa Research Foundation, 214 Technology Innovation
Center, Iowa City, Iowa 52242. A license to these patents for commercial use must be
obtained directly from the University of Iowa Research Foundation. For further information,

CMV5 promoter
Use of the CMV5 promoter is covered under U.S. patent number 5,518,913 owned and
licensed by the Biotechnology Research Institute (BRI), National Research Council of
Canada, 6100 RoyalMount Avenue, Montreal, Quebec, Canada, H4P 2R2. Commercial and
non-commercial research institutions are granted an automatic license with the purchase of
this product to use the CMV5 promoter only for internal research purposes, which license
specifically excludes the right to sell, or otherwise transfer the CMV5 promoter or its component
parts to third parties. A license to this patent for commercial use must be obtained
directly from the BRI.
GFP
Use of the GFP is covered under U.S. patent number 6,027,881 owned and licensed by the
National Institute of Health (NIH) and is restricted to the research market field. A license to
this patent for commercial use must be obtained directly from the NIH, Office of Technology
Transfer, Bethesda, MD 20892.
Use of the GFP is also covered under U.S. patent number 6,146,826 owned and licensed by
Colombia University. Rights to use this product are limited to research use only; not for diagnostic
or therapeutic use in humans or animals. No other rights are conveyed. Inquiry into
the availability of a license to broader rights or the use of this product for commercial purposes
should be directed to Columbia Innovation Enterprise, Columbia University, Engineering
Terrace-Suite 363, Mail Code 2206, 500 West 120th Street, New York, New York 10027, USA.
AdEasy™ and AdenoVator™
AdEasy™ and AdenoVator™ products are covered under U.S. patent number 5,922,576
from Johns Hopkins University. Rights to use these products are limited to broader rights or
the use of these products for commercial purposes should be directed to Johns Hopkins
University School of Medicine Office of Technology Licensing, 111 Market Place, Suite 906,
Baltimore, MD 21202. Purchase of these products does not grant rights to: (1) offer the vectors
or any derivatives thereof for resale; or (2) to distribute or transfer the vector or any
derivative thereof to third parties. |

Q-mate™ Inducible Expression System
Use of the Q-mate™ Inducible Expression System (patent pending) is licensed to
Qbiogene by the Biotechnology Research Institute, National Research Council of Canada.
The technology is available through several options:
Academic Research Agreement: Q-mate™ Products are sublicensed to academic
institution for research purposes only. Academic purchaser agrees that Products purchased
will be used only at non-commercial institutions and only in research that is not
sponsored by or pledged to be licensed to commercial entities. Commercial entities and
non-profit organizations conducting research sponsored and/or in collaboration with
commercial entities must refer to the Commercial Research Evaluation Agreement. No
other rights are conveyed with the sale of the Products hereunder. Purchase of the
Products does not convey any rights to (i) offer the vectors or any component, derivatives
or modification thereof for resale, or (ii) distribute, transfer or otherwise provide access
to, the Products or any component, derivative or modification thereof to any third party
for any purpose or use.
Commercial Research Evaluation Agreement: Q-mate™ Products are sublicensed to
commercial institutions for 6 month commercial evaluation purposes only. Commercial
entities and non-profit organizations conducting research sponsored and/or in collaboration
with commercial entities require a separate sub-license from Qbiogene after the 6
month Commercial Research Evaluation Agreement period. No other rights are conveyed
with the sale of the Products hereunder. Purchase of the Products does not convey any
rights to (i) offer the vectors or any component, derivatives or modification thereof for
resale, or (ii) distribute, transfer or otherwise provide access to, the Products or any
component, derivative or modification thereof to any third party for any purpose or use.
Commercial Research License Agreement: Following the 6 month Commercial Research Evaluation Agreement, commercial entities and non-profit organizations conducting
research sponsored and/or in collaboration with commercial entities require a
Commercial Research License Agreement from Qbiogene. A Commercial Research
License Agreement does not convey any rights to (i) offer the vectors or any component,
derivatives or modification thereof for resale, or (ii) distribute, transfer or otherwise provide
access to, the Products or any component, derivative or modification thereof to any
third party for any purpose or use.
Clinical Development and Commercialization Agreement: Licenses can be obtained to
allow clinical development and commercialization of a named product generated using
the Q-mate™ Inducible Expression System. Users often continue to hold a Research Agreement when a license is in place, thus allowing them to continue to evaluate new products in the laboratory.
Services: Qbiogene can create Q-mate™ derived materials and manufacture research,
GLP or cGMP grade product. The advantage of this approach is that Qbiogene brings
extensive experience to the project.
